Please read these Terms of Service carefully before using LaunchDrop. By using our platform, you agree to these terms in full. If you have questions, contact us at hello@launchdrop.com.
1. Acceptance of Terms
By accessing or using LaunchDrop, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform. These terms apply to all users including buyers, sellers, and visitors.
2. Description of Service
LaunchDrop is a marketplace platform that enables sellers to list ready-made websites for sale and buyers to purchase them. We facilitate transactions but are not a party to the sale agreement between buyers and sellers. We provide escrow services, dispute resolution, and platform infrastructure.
3. User Accounts
You must be 18 years or older to create an account. You are responsible for maintaining the security of your account credentials. You may not share your account or use another person's account. You must provide accurate information during registration. One account per person is permitted.
4. Seller Obligations
Sellers must ensure all listed websites are fully built, functional, and match the listing description. Sellers must deliver within the stated timeframe. Sellers may not solicit buyers to transact outside of LaunchDrop. Sellers must hold all rights to listed websites. Sellers are responsible for any tax obligations on earnings.
5. Buyer Obligations
Buyers must provide accurate branding information for customization. Buyers have 3 days after delivery to raise a dispute. After this period, funds are automatically released to the seller. Buyers may not request refunds except in cases of non-delivery or material misrepresentation.
6. Payments and Fees
All payments are processed via Paystack. LaunchDrop charges a commission on each sale as outlined in our pricing page. Subscription fees for Pro and Agency plans are billed monthly. All fees are non-refundable unless otherwise stated. We reserve the right to change our fee structure with 30 days notice.
7. Escrow and Payouts
Buyer payments are held in escrow until delivery is confirmed. Funds are released to sellers 3 days after the buyer confirms delivery. If no dispute is raised within 3 days of delivery, funds are automatically released. Payouts are processed via Paystack to the seller's registered bank account or mobile money.
8. Prohibited Content
Users may not list or sell websites containing adult, explicit, or illegal content. Gambling platforms, phishing sites, and sites promoting harmful activities are prohibited. Users may not list websites that infringe on third-party intellectual property rights.
9. Dispute Resolution
LaunchDrop provides a dispute resolution service for buyer-seller conflicts. Disputes must be raised within 3 days of delivery. Our team reviews all disputes and makes final decisions based on available evidence. LaunchDrop's decision in disputes is final and binding.
10. Intellectual Property
Sellers retain ownership of their website code and assets until purchase. Upon purchase, ownership transfers to the buyer as specified in the listing. LaunchDrop retains rights to the platform, branding, and marketplace infrastructure.
11. Termination
LaunchDrop reserves the right to suspend or terminate accounts that violate these terms. Users may close their accounts at any time. Outstanding orders must be fulfilled before account closure. LaunchDrop is not liable for any losses resulting from account termination.
12. Limitation of Liability
LaunchDrop is not liable for the quality, safety, or legality of items listed. We are not responsible for seller or buyer conduct. Our liability is limited to the fees paid to us in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.
13. Changes to Terms
We reserve the right to modify these terms at any time. Users will be notified of significant changes via email. Continued use of the platform after changes constitutes acceptance of the new terms.
14. Governing Law
These terms are governed by the laws of the Republic of Ghana. Any disputes arising from these terms shall be subject to the jurisdiction of Ghanaian courts.
